Suing nexon for lack of incompetence

As someone who has played for many years, I have seen many people get banned in this game including some of my friends who have spent much money on this game.
I also have spent lots of money on this game and I cant take it anymore as I have just been unfairly banned for hacking when I never did so.
They never stop the real hackers or botters or scammers who continue to hack and scam and reports are ignored, else these people would be banned already.
They never provide any good service, the game has been downhill for a number of years now due to the crappy servers and lag and the horrible game content.
Im already looking to calling up a lawyer and seeing what my options are. Im just announcing this in order to express my feelings on the issue. If you guys have any feedback or suggestions on what to do about this that would be greatly appreciated. Thanks for reading this and wish me good luck.

Although I understand your frustration in this situation, @GlobalKorean is spot on. Nexon owns your account, therefore it's their intellectual property and they have exclusive rights to it. When you create your account, you agree not only to their TOS but as well as an Arbitration Agreement (Which is found in their End User License Agreement). Essentially, you accepted a term which stated that you would not take Nexon to court, meaning that your complaint would first go through arbitration. This would be a negotiation between you, Nexon, and an external Arbitrator (Decides outcome of dispute). Unfortunately, this whole entire process is not only tedious but would consist of thousands of dollars worth of fees (attorney, arbitrator, etc). You would NEED solid evidence to back your side, displaying Nexon's incompetence, or as stated in the End User License Agreement, "Fraudulent Misrepresentation" (under the assumption that is your claim). Also to note, if you wanted to sue, you would need to go to California to sue them, which would really not be ideal since you would then need to find an attorney there, and imagine the additional costs associated with that. It's really not worth it. Better off starting fresh, or just quit!

Just quit and explain the circumstances of your situation to whoever expresses interest in the game if you want to have a meaningful impact. Nexon speaks in $$ so less new players means less $$.

Obviously, judging from their most recent financial release, Nexon America looks like they're on the verge of collapse...(lost over 20% in revenue compared to last year and their net loss grew by over 20% as well) and no one runs a business to lose money so....

@basedmsguy: A lot of people here are die hard maple players and have issues of their own. I'm sure other people who have quit for your reasons would support you, but most of them are somewhere else. Could there be a case? Yes. Prepare to be a martyr, though, if the case is lost. You can't be naive and expect unconditional support. You have to be driven by principles rather than people.

Oh, boy, you got treated unfairly by Nexon? What's new? I just restarted on Reboot last month after being losing my account during a server leak back when Jump! was about to be added to GMS.

I'm not one of those guys that whines about their problems being worse and telling others to get over it, but dude, it's just a game. Go play Borderlands 2 with some friends, and then see if you still feel the same way afterwards.

I'm just telling you this so you don't waste your money and time. Say you win and are approved for compensation for court fees, you're just wasting your precious time over an account for a free game that's old enough that I've doubled in age since I first played. It's just not worth the stress on yourself.

From giving your post a second read, all you're complaining about is how you feel like you've been treated unfairly by Nexon or the DEVs of Maplestory. Quoted from your post:

In the ToS it states two very important statements about 'Account Ownership' and 'Purchasing Virtual Items', in which, you agreed upon creating your account(s).

-Account Ownership- (Section 2.6)
'You acknowledge and agree that you shall have no ownership or other property interest in your account, and you further acknowledge and agree that all rights in and to the account are and shall forever be owned by and inure to the benefit of Nexon'

Meaning upon creating your account a box would have appeared saying 'Do you agree with our terms and service' and by clicking said box you agreed before spending any money at all, that the account will ultimately be owned by Nexon (Not by you).

-Purchase of Virtual Items- (Section 2.7)
'Anything obtained in our stores is not purchased by you, but rather is licensed to you under the terms of this ToS and the applicable agreements.' OR 'You acknowledge that the NX acquired through the Service is not real currency or any type of financial instrument and is not redeemable for any sum of money from us at any time.'

Meaning, just because you spent probably thousands of dollars on a virtual game,(on an account originally you had no ownership to) doesn't make it magically yours.

If you dislike my original statement of 'Quit', then I recommend you to read the terms of service of any game before you sign up.

tl;dr - Don't waste our time with your petty lawsuits and blank threats. Quit the game or get over it.

The lack of encouragement here is very disappointing. Dont you guys realize there is a very serious problem in our hands here? Why are we allowing these things to happen when we can take action and actually stop these things from ever happening?

I know its hard to believe, but I seriously have never ever used any other programs to hack the game. Mark my words.

People that use VPN's and anti ping programs often say they were banned unfairly, but they used a 3rd party program to connect to the game.
