Is something wrong with this kid or his school?
So I work in a prep school on weekdays. This prep school is for elementary school kids to come and finish their homework. There is a 4th grader who does not know English. He told me in Mandarin that he was in America for 2 years already. So that made me wonder how the hell does he get to go to the next grade if he knows no English. Like legit I forced him to copy the alphabet because he did not know it. Does his regular school teacher not attempt to fix him? Also the fact that he doesn't know English means he either doesn't get homework from his regular school, or gets very minimal homework. When he does get minimal homework, it's my job to ensure he finishes it, so I have to "teach" him how to do it. But then after he completes it and puts it away, I know he learned nothing. Kids in his class from regular school who are in the prep school I work at told me in class he just relies on people around him to give him answers. Who is responsible for him never learning English after coming to America?

It would never be the kid's problem. It's not his fault for not knowing English. He just recently came to this country so he's going to learn over time. And if the negative results continue, then it's the school's fault.
English is an extremely hard language, if not the most due to the idiotic rules of it.

Tell the school about it.
However, since the school is poor, the student going to be missing a lot of useful things to learn: English, proper use of English, or even teachers who actually teach. Perhaps, talk to this parents about sending him to a bigger public school with more money; so he can get better education.
I think there's a law somewhere that school districts should hire people to accommodate students that don't know English.
However, if your district is poor (like most.) and the language is slightly more uncommon it can be very hard for them to do this.
Personally, i think the kid should at least make an effort to teach himself English instead of having others do his work for him. He shouldn't be expected to know perfect grammar and everything but it's a shame he has such a poor attitude.
Edit: The school being poor can be due to a lot of things as well. Their state could constantly be cutting the education budget (like mine) or the district could be embezzling money (depending on how small it is.) or just spending it on questionable things.

Should be the ESOL teachers at his school... unless the district is broke and can't afford them (*coughminecough*)
But he should also put in some effort to learning English, teacher-student partnership stuff
