question about contracts and stuff

If a restaurant signed up with a website, should the company have a copy or have the actual contract with signed signatures? Because we cancelled the website and paid a deposit, but they won't give the money back and we never signed a contract telling us details of certain things because we did not know about them or were not told. They said we should have a contract outline but we never did and it was through the phone. So should a company have the copy or the actual contract with signatures?

Well you can't prove anything if you didn't sign a contact.. you basically gave the website people free money.
There should always have a signed contract when you exchange money for anything non-tangible.
